For the patient

A patient suffering from a disease or illness, enduring pain or difficulties, and sometimes under the care of untrained or unqualified doctors or therapists, may find themselves dissatisfied with their ongoing treatment plan. Here, diagnotreat.com provides a solution by offering a platform where you can seek a second opinion from other experienced doctors or therapists in your area and receive advice from the online system.

You may upload and save your case history, physical and mental status, old prescriptions, and diagnostic reports on your dedicated dashboard.  Maintaining your privacy, comfort, and a supportive environment, we aim to provide a cost-effective and time-saving solution without compromising the quality of healthcare.

The Consultant

A health consultation is a clinical encounter that can be defined as “A meeting between a physician and patient, at which health-related issues are presented and explored and management decisions are made.” An effective consultation should always be performed with patience, and a relaxed mind has a positive impact on the patient’s care. 

Any healthcare professional (from complementary or conventional therapy) will serve as a consultant on www.diagnotreat.com and can provide their best advice to our registered patients. The primary responsibility of a consultant is to understand the patient’s physical and mental conditions and then offer them the best advice with their full expertise. As we support a holistic approach to treatment, we promote all therapies, including Allopathy, Homeopathy, Ayurveda, Naturopathy, Yoga, Acupressure, Acupuncture, Healing therapy, and more.  

We may promote you on our different social media platforms.  After completing registration with us, you may get patients of your specialization from your nearby area.  You can give them online consultancy and get your consultancy fee directly into your account from patients through UPI or other payment transfer modes.  You may refer to higher institutions or specialized consultants, or to diagnostic centers.  You may keep a date-wise data record of your forwarded patients on your dedicated dashboard.

A medical practitioner or healthcare provider/consultant/service providers/ health centers, whether an individual professional or an organization or institution wishing to be listed or already listed on the website, including designated, authorized associates of such practitioners or institutions,
  2. A patient or his/her representative or affiliates, or our consultant searching for practitioners through the website diagnotreat.com.
  3. This agreement applies to those who create and maintain “Health accounts”, search consultants by name, specialty, or geographical area, or any other criteria, that may be developed and made available by “diagnotreat”, and to make appointments with registered healthcare providers/consultants.
  4. This agreement applies to consultants, healthcare providers, health service providers, healthcare centers, and diagnostic centers, including the listing and creation of their profiles and contact details, which will be made available to other users and visitors of the website.
  5. The Services may change from time to time, at the sole discretion of Monchi Health & Education Consultancy LLP, and the Agreement will apply to your visit to and your use of the Website to avail the service, as well as to all information provided by you on the Website at any given point in time.
  6. This agreement defines the terms and conditions under which you are allowed to use the website and describes how we shall treat your account while you are registered as a member with us. If you have any questions about any part of the agreement, feel free to contact us at contact@diagnotreat.com.
  7. We reserve the right to modify or terminate any portion of the Agreement for any reason and at any time, and such modifications shall be available in terms and conditions of the site; you should read the Agreement at regular intervals. Your use of the Website following any such modification constitutes your agreement to follow and be bound by the Agreement so modified.
  8. You acknowledge that you will be bound by this Agreement for availing any of the Services offered by us. If any registered coordinators or any other person is providing personal information on behalf of a third party, then you hereby undertake and confirm that you have the legal authority to do so and to agree to this policy on behalf of such third party. If you are providing any personal information on behalf of a minor, you hereby confirm that you are the parent or legal guardian of such minor.
  4. It is also suggested that you should not share any personal information that may cause you any financial loss or impact. You hereby consent that the collection, storage, processing, disclosure, and transfer of any personal information shall not cause you any wrongful loss if it is done following the provisions of this Privacy Policy.
  5. You will also have an option to delete your account with us if you want to withdraw your consent at any point, provided such withdrawal of the consent is intimated to us in writing, we can delete your registration.
  6.   12. All information submitted for the business listing
  13. User details as provided at the time of registration or thereafter,
  14. Records of interaction with listed consultants/coordinators,
  15. All related business in the form of referrals or commissions will be recorded for future support and growth.
  16. Your usage details such as time, frequency, duration, and pattern of use, features used, and the amount of storage used,
  17. All master data and transaction data are stored in your user account/dashboard.
  18. Internet Protocol address, browser type, browser language, referring URL, files accessed, errors generated, time zone, operating system, and other visitor details collected in our log files,
  19. Any other information that is willingly shared by you.
  20. All information provided/shared by you or your representative is referred to as your “Personal Information“.

Everything we offer on the Website, i.e., www.diagnotreat.com is referred to in this Agreement collectively as the “Services.” Some information available on the Website, i.e., www.diagnotreat.comis viewable without registering with us, but to avail benefit of most Services, you must register as a member and authorize the use and disclosure of your personal and health information for purposes of allowing us to provide the Services and as otherwise disclosed in our Privacy Policy.

ABOUT RECEIVING MEDICAL SECOND OPINION THROUGH DIAGNOTREAT.COM

The Services are being made available to you on the following assumptions:

  1. That the patient for whom a medical second opinion is being sought is an Indian citizen who is alive and is presently residing in India;
  2. That the patient is already under the care of a local qualified and specialized medical practitioner (“Treating Physician”).
  3. That the patient seeks a second opinion on the medical response (diagnosis, prognosis, treatment, etc) that has been offered to him/her strictly in good faith and that such opinion shall not be used against any person in any manner.
  4. That the patient is willing and is in a position to visit the qualified medical practitioner (“Specialist”) to seek medical consultation, but owing to be distance and cost involved, the patient would first like to understand what kind of medical response would be offered to the patient by the specialist. This is the sole premise of the patient to use the Website, i.e., diagnotreat.com, and the specialist to offer his/her medical second opinion to the patient.
  5. That the medical second opinion provided on the Website, i.e., diagnotreat.com is based on the information that you make available to the specialist/consultant/coordinator and is subject to be improved upon or modified in the event of an in-person examination and/or further tests carried out by such Specialist or any other qualified medical practitioner.
  6. That you are aware that the Specialist with whom you interact on the Website, i.e., diagnotreat.com is qualified and licensed to provide medical second opinion in the geographical area where the medical practitioner resides, that he may or may not be located in India, and that if there was ever a question on the precise location where the medical second opinion was provided, it would always be the area where the medical practitioner resides and not the area where you reside or have business.
  7. That the medical second opinion is intended as a guide for the Treating Physician and that you (or if you are not the patient, the patient) will not draw any conclusion or inference from the medical second opinion received on the Website.
  8. That by providing the medical opinion, neither the Company nor the concerned Specialist agrees to assume charge of your care.”
  9. That, under no circumstances, a prescription for medicines shall be issued to you.

If the patient or representative does not agree with any of the above statements either wholly or partly, please do not use the Services or access the website, i.e., diagnotreat.com.

LIMITATIONS OF ONLINE MEDICAL CONSULTATION THROUGH A WEBSITE

As we are providing online medical consultation as a second opinion over the internet, by conventional and complementary healthcare services, there are certain inherent limitations to delivering this, as users may understand. These limitations include:

  • In some cases, the consultant may feel that the information provided is inadequate to provide a good quality second opinion and may ask for further call information to be provided for clarity and severity of the problem.
  • Occasional delays are possible due to the complexity of the case or technical issues, or other reasons.
  • Despite all precautions to ensure cybersecurity, an occasional breach of the confidentiality of data is possible.
  • In rare cases, a lack of access to complete medical records or other reasons may result in adverse drug interactions, allergic reactions, or other judgment errors.
  • It is also advised to approach to nearby hospital directly in case of any emergency.

DISCLOSURE OF MEDICAL INFORMATION

The Company takes seriously the privacy of your medical records, health information, and personal information. Accordingly, we have taken all reasonable precautions necessary to protect your privacy, following all applicable laws.

NO DOCTOR-PATIENT RELATIONSHIP

You acknowledge and agree that although some of the content, text, data, graphics, images, documents, information, suggestions, guidance, and other material (collectively, “Information”) that is provided to you on the Website, i.e., www.diagnotreat.com (including Information provided in direct response to your questions or requests) may be provided by individuals in the medical profession, the provision of such Information does not create a medical professional – patient relationship since the opinion is provided to assist you and/or your Treating Physician in making the right choices in terms of medical care.

DEPENDENCE ON DIAGNOTREAT.COM -

You acknowledge and agree that any Information, including a medical second opinion, received on the Website, i.e., www.diagnotreat.com, as a part of the Service, does not constitute a final diagnosis, medical advice, treatment, or medical care. Furthermore, you understand and agree that your treating consultant(s) will remain at all times solely responsible for your diagnosis, care, treatment, and evaluation of the second opinion received.  You must share the medical second opinion with your treating consultant and allow him/her to process it and take appropriate medical course of action. Your primary professional relationship remains with your treating consultant.

PAYMENT OF FEES

You acknowledge that you or any authorized individual/coordinator acting on your behalf and who is requesting a medical second opinion is responsible for all fees charged by the Company for the services. You understand that you (or anyone else authorized by you) must pay these fees in advance, and that it is your responsibility to pursue any third-party insurance reimbursement at your own expense, if any.  Company (Ms Monchi Health & Education Consultancy LLP) or website (www.diagnotreat.com) is not responsible in case of any payment made by you or your representative for consultation or conducting any medical tests or admission or for opinion or any other reasons to the consultant or coordinator or hospital, or diagnostic centers. 

In case of any discrepancy or legal proceeding, we are only liable to provide you with the available information of the organisation/individual on behalf of legal documents in the name of the subject.

REFUNDS POLICY

The Company believes in the quality of its services and incurs substantial costs to make the services available to you. Therefore, the Company does not offer a part or full refund against its Services under any circumstances.

If you are not satisfied with the medical second opinion provided to you, you may write about your grievance along with detailed reasons for your dissatisfaction to support@diagnotreat.com.  We assure you that your grievance will be processed objectively and, where appropriate, a revised medical second opinion will be issued to you.

You have been informed in the Privacy Policy that you have the option to withdraw consent for the use of your personal information, medical records, and health information at any time. However, if you withdraw your consent after the advance payment is made, the advance will not be returned, or it is subject to the will of the coordinator or others.

REFUNDS POLICY

The Company believes in the quality of its services and incurs substantial costs to make the services available to you. Therefore, the Company does not offer a part or full refund against its Services under any circumstances.

If you are not satisfied with the medical second opinion provided to you, you may write about your grievance along with detailed reasons for your dissatisfaction to support@diagnotreat.com.  We assure you that your grievance will be processed objectively and, where appropriate, a revised medical second opinion will be issued to you.

RELEASE OF LIABILITY

You further release and hold harmless the Company and its respective physicians, employees, coordinators, consultants, contractors, business associates, and/or agents from any harm, claim, injury or damages of any kind including, but not limited to, compensatory, direct, indirect or consequential damage, directly or indirectly, as result of any and all uses of the Services hereunder and any review, interpretation or analysis or and/or reliance on any and all Information, including medical second opinion.

RESTRICTIONS ON USE OF WEBSITE

Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs, video clips, and written and other materials that are part of Company or Company’s Web Site(s) are copyrights, trademarks, trade dress and/or other intellectual property owned, controlled or licensed by Company. No material from the Company’s Website (s) or any other Company website, i.e., www.diagnotreat.com, may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except with the express written consent of the Company.

LICENSE TO ACCESS

  • collect or store personal data about other users in connection with the prohibited activities described in this paragraph.

In addition to our rights in these Terms of Use, we may take any legal action and implement any technical remedies to prevent the violation of this provision and to enforce these Terms of Use.

CHANGES TO THIS AGREEMENT

We may terminate your membership or access to the Website, i.e., www.diagnotreat.com, immediately and take other legal action if you or anyone using your Credentials violates these provisions.

CONTENT YOU POST OR SUBMIT

You may be allowed to submit feedback regarding your experiences with doctors who are featured on the Website, to submit inquiries concerning possible medical needs, and to participate in the other interactive and community features of the Site (collectively “Posted Information”). In addition:

  • You are solely responsible for any posted information that you submit, publish, or display on the Site or transmit to other members and/or other users of the Site.
  • You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. You may not submit any content or material that infringes, misappropriates, or violates the intellectual property, publicity, privacy, or other rights of any party.

PATIENT EMERGENCIES

The Company’s Services are not a replacement for emergency services offered at hospitals and should not be used or accessed if the patient is in a critical or unstable state. In the event of an emergency, please contact local emergency services and/or proceed to the nearest hospital.

In the event of the death of any patient at home, the Company may request for a medical post-mortem report. The Company will not provide a death certificate. 

DATA RECORDING, STORAGE & USAGE

The information stored by the Company may be entered by you or by a Specialist assigned to you, or by the Company itself in the course of provision of Services to you. The information collected as part of the Services may be stored on your mobile device as well as on a cloud platform or a server hosted by a third party.

All video-consultations/IM chat consultations/text messages/audios/videos/transcripts/opinions and any other form of correspondence between you and the Specialist shall be recorded, saved, and stored for record and legal archival purposes.

All the information shall be recorded, saved. and stored electronically on a server owned and managed by a third party. The Company shall ensure that the third party uses appropriate levels of encryption to protect data and takes all necessary precautions. The Company shall, however, not be responsible for any cyber data theft from its Website, i.e., www.diagnotreat.com, and from such third party.

After the conclusion or termination of any Service, the Company reserves the right to permanently delete any user information, including personal information, health information, and medical records, without notice unless such Service is renewed.

DISCLAIMERS

Although every effort will be made to generate a medical second opinion report in a reasonably timely fashion, the Company makes no representation or warranty as to the quality, sufficiency, or timeframe in which such second opinion report will be generated.

The website, i.e., www.diagnotreat.com  and Services provided by the Company are provided on an “as is” and “as available” basis, and without any warranties or conditions (express or implied, including the implied warranties of merchantability, accuracy, fitness for a particular purpose, title and non-infringement, arising by statute or otherwise in law or from a course of dealing or usage or trade). To the fullest extent permitted by law, the Company disclaims all liability arising out of any use or reliance on the Services received on the Website, i.e., www.diagnotreat.com(including medical second opinion), the content on the Website, i.e., www.diagnotreat.comor any opinion or suggestion given or expressed by the Company or its contractors and agents (including HSPs), or unavailability of Services. 

Specifically, the Company disclaims any liability arising out of deterioration of a prior medical condition or a new medical event that occurs on account of omission to provide critical and material health information by you to the Specialist. 

The Company assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect your equipment on account of access to, use of, or browsing the Website, i.e., www.diagnotreat.comor the downloading of any material, data, text, images, video content, or audio content from the Web Site. You must stop using the Services and/or the Website, i.e., www.diagnotreat.com, immediately if you believe that it may have or has affected your equipment in any manner. 

You are encouraged to independently verify any information you receive from the website.

In no event shall the total aggregate liability of the Protected Entities towards you for all damages, losses, and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from the terms and conditions your use of the Website, i.e., www.diagnotreat.com exceed, in the aggregate, Rupees One Thousand (INR 1000) or the amount of payment against Services that has been directly received by the Company from you in the past three months, whichever is lower.

APPLICABLE LAW, JURISDICTION OF COURTS AND DISPUTE RESOLUTION

This Agreement shall be governed by and construed under the laws of India. The competent courts of Delhi shall have jurisdiction to adjudicate and grant urgent interim reliefs to the Parties.  The Parties shall have the right to apply to a court of competent jurisdiction to obtain interim injunctive relief in respect of any dispute pending resolution of such dispute following the execution of this Agreement.

MISCELLANEOUS

Severability: If any provision of this Agreement is held by a court of competent jurisdiction or arbitral tribunal to be unenforceable under applicable law, then that provision shall be excluded from the Agreement. The remainder of the Agreement shall be interpreted as if that provision was excluded and shall be enforceable according to its terms; provided, however, that in that event, the Agreement shall be interpreted to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by the court of competent jurisdiction or arbitral tribunal.

Notices: All notices and other communications required or permitted hereunder to be given to a Party shall be in writing, in the English language, and shall be sent by e-mail, or mailed by prepaid internationally-recognized courier or otherwise delivered by hand or by messenger, addressed to such Party’s address as set forth below or at such other address as the Party shall have furnished to the other Party in writing in accordance with this provision:

Waiver: No term of the Agreement shall be deemed waived and no breach excused, unless such waiver or consent shall be in writing and signed by the Party claimed to have waived or consented. Any consent by any Party to, or waiver of a breach by the other, whether expressed or implied, shall not constitute consent to, waiver of, or excuse for any other different or subsequent breach.

Complete Understanding: The Agreement contains the entire understanding of the Parties, and there are no other written or oral understandings or promises between the Parties with respect to the subject matter of the Agreement other than those contained or referenced in the Agreement.

Force Majeure (Act of God): The Company shall not be liable for any downtime or delay or unavailability of the Application caused by circumstances beyond the Company’s reasonable control, including without limitation, acts of God, acts of government, floods, fires, earthquakes, civil unrest, acts of terror, strikes or other labour problems, internet service provider failures or delays, or denial of service attacks.

Advertisement: The Company shall have the right to place advertisements and publicity materials of its choice, including those pertaining to parties other than itself, for commercial use through electronic means on the Application.  

Assignment: You may not assign or sublicense, without the prior written consent of THE COMPANY, the rights, duties, or obligations under this Agreement, in whole or in part, to any person or entity.

Conflict: In the event there is any conflict between the terms set out in these Terms of Use, the Privacy Policy, and any other policies applicable to specific pages of the Application, the following order of prevalence shall apply: (i) any additional Service-specific terms and conditions.
